Chair’s Opening Remarks

Seeking to harmonise digital protocols, the EU will introduce new PSD2 (Payment Services Directive) measures (inbound September 2019) on financial transactions, running alongside its 2018 GDPR policies on consumer data protections. If the UK is outside the EU by this time, where does that leave the market? And will credit card interchange rates begin to climb outside of European rules?

Approach with caution: interpreting the US Wire Act! 2018’s repeal of federal PASPA laws, has led to the US market becoming betting’s clear and present opportunity for growth. However, whilst PASPA has been rescinded, online betting and its financial stakeholders are still anchored to the legacy mandate of 1961 Interstate Wire Act.

Furthermore, individual European governments are reviewing whether to implement tougher credit ‘source-of-fund’ checks on consumer interactions with online betting services (UK, Belgium, Spain & Ireland). How will increased compliance demands impact betting’s value chain and operational structures - as betting operators seek to expand effectively in new markets, will an ‘active presence’ be needed in each member-state to fulfil compliance procedures?

As new and established US gambling stakeholders search for a level of uniformity on sports wagering regulatory policy, how should Wire Act provisions be interpreted? Furthermore, at a transactional point are payment incumbents willing to roll-the-dice on loose/ varied Wire Act definitions, playing the game of chicken with the US Department of Justice (DOJ).

2018 saw the industry marred by a number of high coverage compliance failures. The record penalties sanctioned by the UKGC point towards a failure by bookmakers and gambling operators to interact appropriately with their customers, and follow UK credit procedures.

As the UK proceeds with its Post-Brexit transition, 2019 will see the European Union continue to emphasises its agenda on improving digital consumer standards and protections.

Furthermore, in 2019 government stakeholders have called for operators to ‘get to know their players’ – or face further disciplinary consequences.
